Collection agencies are governed by strict laws such as the Collection and Debt Settlement Services Act, R.S.O. 1990, c. C.14
And regulation 74. Once they receive our cease and desist letter they must stop calling you. if they done the following you may be able to sue for damages:
- => Call your employer to discuss anything except confirm your employment
- => Call your family
- => Call your neighbours
- => Harass and intimidate you.
- => Call you before sending a letter
- => Refuse to Validate the debt
- => Leak or disclose your private information
- => Threaten to sue you
- => Tell you the Sheriff will show up at your door
- => Use scare ad intimidation tactics
- => Threaten to garnish your wages or enforce legal action
You may not owe a debt, the statute of limitations is 2 years to sue.
